UNDERSTANDING YOUR OPTIONS

A property injury claim begins with what happened and what the owner knew.

Falls may occur in stores, restaurants, offices, apartment complexes, parking areas, or other locations. A successful case is not established by the fall alone: the condition, the duty owed, notice, causation, and injuries all matter. The sooner the evidence is preserved, the easier it may be to understand how the incident occurred.

MATTERS WE EXPLORE

Common conditions worth investigating

Every situation is different. These are examples of facts that may be worth discussing—not a prediction about any particular claim.

Wet or slippery floors

Spills, tracked-in water, or cleaning conditions may create hazards that are easy to overlook.

Uneven walking surfaces

Loose flooring, damaged pavement, and unexpected changes in elevation can create risks.

Poor lighting

Visibility can affect whether a hazard is noticeable and how a fall happens.

Obstructed walkways

Boxes, clutter, cords, or merchandise in pedestrian paths may deserve investigation.

Unsafe stairs

Damaged steps, loose handrails, and stairway conditions can contribute to falls.

Recurring hazards

Repeated leaks or other ongoing conditions may be relevant to what the property operator knew.

EVIDENCE & EVALUATION

Preserve what can disappear quickly.

In many premises cases, conditions change within minutes. Video is overwritten, spills are cleaned, and witnesses leave. A prompt review can help identify useful records without assuming that a property owner is automatically liable.

Prompt care, symptoms, diagnoses, limitations, and follow-up appointments.

FLORIDA LEGAL PERSPECTIVE

Florida law looks closely at knowledge of the hazard.

Under Florida Statutes § 768.0755, for a slip on a transitory foreign substance in a business establishment, the injured person generally must prove the business had actual or constructive knowledge of the dangerous condition and should have addressed it. Other premises claims may involve different duties and proof. Legal deadlines may also apply, so a case-specific review matters.

POTENTIAL REMEDIES

Losses that may matter after a serious fall

Possible outcomes and damages depend on the facts, proof, applicable law, and the type of claim. No result can be promised.

Medical care

Past and potentially future reasonable treatment related to the injury.

Lost income

Time away from work or reduced earning ability, if supported by the evidence.

Pain and limitations

Physical discomfort and effects on daily activities, where recoverable.

Long-term needs

Rehabilitation or other future care supported by medical evidence.

WHAT TO DO NEXT

Three practical steps toward clarity.

01 Get medical attention

Put health first and document symptoms even if they develop later.

02 Preserve the scene

Report the event and retain photos, witnesses, shoes, and records.

03 Request a case review

Discuss the condition, notice issues, medical impact, and potential deadlines.

FREQUENTLY ASKED QUESTIONS

Questions worth asking. Answers worth understanding.

Is a business automatically responsible because I fell there?

No. Liability depends on facts such as the dangerous condition, notice, legal duties, causation, and whether the event resulted in injury.

What is constructive knowledge under Florida law?

For certain business slip-and-fall cases, constructive knowledge may be shown through circumstances suggesting the condition existed long enough to be discovered or occurred regularly and was foreseeable.

Should I report the fall to the property manager?

A timely factual report can help preserve a record of the incident. Keep a copy when possible and avoid guessing about facts you do not know.

What if there was no warning sign?

The absence of a warning may be relevant, but it does not by itself prove liability. The condition and notice still need to be evaluated.

How long do I have to bring a claim?

Many Florida negligence actions are subject to a two-year period under current law, but dates, exceptions, and other rules can change the analysis. Obtain legal guidance promptly.
